Welcome to TourCWE! By booking or participating in any of our tours or picnic experiences, you agree to the following terms and conditions, which are intended to ensure a safe, enjoyable, and clearly understood experience for all participants.

1. Scope of services
These Terms & Conditions apply to all experiences offered through TourCWE platforms, including but not limited to:
- Walking tours (culinary, nightlife, historical, etc.)
- Forest Park Picnics curated dining experiences
- Any other experiences or services booked through our platforms
2. Booking and payment
- Full payment is required at the time of booking unless otherwise noted
- All bookings are subject to availability and may be confirmed via email or our online booking system
- For tours: Participants must be 21 years or older for nightlife tours, or accompanied by a legal guardian
- For picnics: Bookings can be made up to 6 hours before the scheduled experience time
3. Cancellation & refund policy
Cancellation terms — including deadlines, refund amounts, and any applicable fees — are as stated on your booking confirmation and the platform through which you booked (including but not limited to racon.tours, tourcwe.com, forestparkpicnics.com, Viator, and GetYourGuide) at the time of purchase. Those published terms govern your booking and are incorporated here by reference. TourCWE reserves the right to update cancellation policies; changes apply to bookings made after the effective date of the update and do not affect prior confirmed bookings.
TourCWE reserves the right to cancel or reschedule any experience due to severe weather, unsafe conditions, or Unforeseen circumstances. In such cases, a full refund or reschedule option will be offered.
4. Participant responsibilities
By participating in any TourCWE experience, you agree to:
- Follow all safety guidelines and instructions given by your guide or service provider
- Be respectful of other guests, guides, service staff, and community members
- Refrain from excessive intoxication or disruptive behavior during tours or picnic experiences. TourCWE reserves the right to remove individuals from experiences without refund in such cases
- For tours: Acknowledge that walking tours may involve physical activity including uneven terrain, stairs, or changing weather conditions
- For picnics: Acknowledge that outdoor dining involves inherent risks including weather exposure, uneven terrain, insects, and other natural elements
- Be responsible for your own belongings and personal safety during all experiences
5. Food service & dietary restrictions
For picnic experiences:
- All food is prepared and sourced from independent local restaurant partners
- TourCWE does not accommodate food allergies or dietary restrictions at this time
- By booking a picnic, you acknowledge awareness of this limitation and assume responsibility for any dietary concerns
- Food safety and temperature control measures are employed during transport and delivery, but participants acknowledge the inherent risks of outdoor dining
6. Alcohol consumption
Some TourCWE experiences may include stops at bars, restaurants, or breweries where alcohol is available, or may allow participants to bring their own alcoholic beverages (picnics).
- All participants must provide valid ID to consume alcohol
- TourCWE does not encourage excessive drinking and is not responsible for actions taken by participants under the influence
- Participants are responsible for their own alcohol consumption and behavior
7. Use of independent transportation providers
Some tours may include or suggest the use of independent, for-hire transportation providers such as pedicabs, limousines, party buses, or rideshare services. TourCWE does not own, operate, control, or assume liability for any third-party transportation providers.
By participating in these tours, you acknowledge and agree that:
- The use of such transportation is at your own risk
- TourCWE is not responsible for any injury, loss, delay, inconvenience, or damage caused by or related to the use of independent transportation providers
- Any issues or claims arising from third-party services must be addressed directly with the provider
8. Third-party restaurant & vendor partnerships
For picnic experiences and culinary tours:
- Food and beverages are prepared by independent restaurant partners
- TourCWE is not responsible for food quality, preparation, allergic reactions, foodborne illness, or any other issues arising from third-party food providers
- Any complaints or issues regarding food quality or safety should be reported to TourCWE, but ultimate responsibility lies with the preparing establishment
9. Photography & media release
By participating in our experiences, you consent to being photographed or recorded for promotional use unless you opt out before the conclusion of your experience.
Photography and video recording may occur during tours and picnic experiences. These images may include candid or posed shots of individuals, groups, and public spaces, and may be used for promotional purposes by TourCWE.
By joining any TourCWE experience, you grant TourCWE, its representatives, and authorized media personnel the right to:
- Photograph and/or record you during the experience
- Use your image, likeness, and/or voice in promotional materials including websites, social media, marketing, and advertisements
- Reproduce, distribute, and publicly display such materials worldwide, in perpetuity, and without compensation
To opt out, notify your guide at any point before the conclusion of your experience. A written opt-out request sent to info@tourcwe.com at least 24 hours before your experience is also accepted. If you believe your image was used without proper consent, contact us at info@tourcwe.com and we will address your request promptly.
10. Weather & outdoor conditions
For picnic experiences:
- All picnics take place outdoors in Forest Park and are subject to weather conditions
- Participants are encouraged to check weather forecasts and dress appropriately
- TourCWE will proactively cancel picnics in cases of severe weather forecasts (heavy rain, storms, extreme temperatures)
- Participants assume all risks associated with outdoor dining including but not limited to weather exposure, insects, wildlife, and park conditions
11. Limitation of liability
TourCWE, its owners, employees, agents, representatives, and partner vendors shall not be held liable for any injury, accident, loss, damage, illness, allergic reaction, or delay resulting from participation in any tour or picnic experience, including but not limited to:
- Acts of nature or severe weather
- Third-party actions (restaurants, transportation providers, other participants, park visitors)
- Personal negligence or assumption of risk
- Food allergies, dietary reactions, or foodborne illness
- Loss or damage to personal belongings
- Outdoor hazards including uneven terrain, weather exposure, insects, or wildlife
Participants are responsible for their own belongings, health, safety, and behavior during all experiences.
12. Force majeure
TourCWE shall not be liable for failure to perform its obligations due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government restrictions, public health emergencies, strikes, or other unforeseen events. In such cases, TourCWE will offer a refund or reschedule option.
13. Agreement & jurisdiction
These Terms & Conditions are governed by the laws of the State of Missouri. Any legal disputes shall be resolved in the appropriate courts located in St. Louis, Missouri.
By booking any experience with TourCWE, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
